KEPT Vintage Market — Vendor Terms & Conditions

Thank you for your interest in vending at KEPT by Patchwork. By applying to or participating in any KEPT market, you agree to be bound by the following Terms and Conditions. These Terms apply to all accepted vendors, their employees, assistants, and anyone operating within their assigned space.

1. Definitions

“We / Us / Our” refers to KEPT by Patchwork and its organizers.

“You / Your” refers to the vendor, their business, and any agents, staff, or representatives associated with them.

“Space” means the booth or table assigned to you for a specific market.

“Vendor” refers to any person or entity approved to hold a space at a KEPT market.

“Market” refers to any single KEPT by Patchwork event.

2. Application and Selection

Vendor applications are juried based on the quality, curation, and relevance of your inventory to the KEPT market format. We reserve the sole right to accept or deny any application without obligation to provide reasoning. Submission of an application does not guarantee acceptance.

All information provided in your application must be truthful and accurate. We reserve the right to revoke participation, even after acceptance or payment, if any part of the application is found to be false or misrepresented.

3. Fees and Payment

A non-refundable $10 application fee is required at the time of submission.

Accepted vendors will receive a payment link by email. Booth fees must be paid in full within 7 days of your acceptance notification. Failure to pay by the deadline will result in forfeiture of your space, which will be offered to the next vendor on the waitlist.

All fees are non-refundable and non-transferable under any circumstances.

Vendors who are accepted to multiple markets receive a discount on their total booth fees:

2 markets: 5% off
3 markets: 8% off
4 markets: 10% off
5 markets: 12% off
6 markets: 15% off

Multi-market discounts are applied at the time of payment and are only available to vendors accepted to those markets.

4. Cancellation Policy

Vendor cancellations made after payment will result in forfeiture of all fees. We do not offer credits, rollovers, or refunds of any kind. In the rare event that KEPT cancels a market due to an emergency as described in Section 13, all fees remain non-refundable.

5. Booth Spaces and Pricing

The following spaces are available per market:

Table Space — one 6′ table, all items must be displayed on top of the table — $85
Standard Booth — 7′ x 8′ — $125
Large Booth — 10′ x 8′ — $175
Corner Booth — 10′ x 8′ corner position — $225

Booths are set directly adjacent to neighboring vendors with no buffer space between them. Vendors are responsible for planning their setup accordingly.

The booth size selected in your application will apply to all markets you are accepted to. You are responsible for providing your own tables, racks, display materials, signage, packaging, and payment equipment.

6. Vendor Eligibility

KEPT is a 100% vintage market. All items sold must be pre-owned, vintage, or antique. New, handmade, or reproduced items are not permitted. We reserve the right to request the removal of any item that does not meet this standard.

7. Space Transfer and Sharing

Booth spaces may not be transferred, sublet, or shared without prior written approval. Any additional vendors wishing to share a space must submit a separate application and be approved in advance. We reserve the right to deny shared space requests or charge an additional fee for approved setups.

8. Conduct

All vendors are expected to conduct themselves professionally throughout the event, including setup and breakdown. Harassment, aggressive sales tactics, or disrespectful behavior toward other vendors, attendees, or staff will result in immediate removal without refund.

Vendors must keep their space clean and leave it free of trash and debris at the end of the event.

9. Booth Appearance and Setup

All displays must be neat, stable, and contained within your assigned space. Displays may not interfere with adjacent vendors, block walkways, or create safety hazards. Load-in times and space assignments will be communicated in advance. Vendors may not move or switch spaces without prior approval.

10. Sales and Tax Compliance

We do not provide point-of-sale equipment. Vendors are solely responsible for managing their own sales, collecting payment, and remitting applicable sales tax in accordance with state and local law.

11. Risk and Liability

All vendors participate at their own risk. KEPT by Patchwork is not responsible for any loss, theft, damage, or personal injury incurred during the market, including during setup and breakdown hours.

Vendors are financially and legally responsible for any damage caused to the venue or their assigned space, and for any injury or loss resulting from their products, displays, or staff.

12. Insurance

Vendors are strongly encouraged to carry general liability insurance, including product liability coverage, with limits of at least $1,000,000 per occurrence. Proof of insurance may be requested at any time. KEPT by Patchwork does not provide insurance coverage for individual vendors.

13. Event Cancellation

All KEPT markets are held indoors and take place rain or shine. In the event of unsafe conditions including severe weather, fire, venue issues, or other emergencies, we reserve the right to cancel or postpone a market. In such cases, all participation fees remain non-refundable and KEPT by Patchwork is not liable for any vendor losses.

14. Limitation of Liability

KEPT by Patchwork is not liable for any direct or indirect damages including lost revenue, business interruption, or personal harm resulting from your participation. Vendors are solely responsible for all claims related to their conduct, products, displays, and staff.

15. Indemnification

You agree to indemnify, defend, and hold harmless KEPT by Patchwork, its organizers, staff, contractors, and the event venue from and against any claims, damages, losses, liabilities, or expenses, including reasonable legal fees, arising out of or related to your participation in any KEPT market.

16. Marketing Use

By participating, you grant KEPT by Patchwork permission to use your business name, Instagram handle, booth photos, and product images for marketing and promotional purposes. You warrant that any content you provide does not infringe on third-party rights.

17. Photo and Video Consent

By participating, vendors consent to being photographed or filmed for promotional purposes. If you wish to opt out of close-up photos of yourself, notify us in writing prior to the event.

18. Enforcement

If you breach these Terms, we reserve the right to cancel your booth without refund, require you to leave the event, and refuse future participation. You are responsible for any costs we incur as a result of your breach.

19. General Provisions

These Terms represent the full agreement between KEPT by Patchwork and its vendors. If any part of these Terms is found to be unenforceable, the remainder stays in effect. No changes are valid unless made in writing by both parties.
